These Terms and Conditions apply to all visitors to forefrontimaging.com and to all sales of goods supplied by Electronic Modular Solutions Ltd (Company No. 02859840), trading as ForeFront Imaging. By placing an order or using this website you accept these terms.
"We", "us" and "our" refer to Electronic Modular Solutions Ltd. "You" and "your" refer to the customer placing an order or using the site. "Goods" refers to any Magewell hardware, accessories, software licences or related items supplied by us.
ForeFront Imaging is the UK distributor for Magewell Electronics. All goods supplied are genuine Magewell stock with full manufacturer warranty.
Prices on the website are guideline trade prices and are subject to written confirmation in a formal quotation. All prices are exclusive of VAT unless stated otherwise. We reserve the right to revise prices without notice; revised prices apply to orders placed after the revision date. Formal written quotations remain valid for 30 days from issue.
Submission of an order is an offer by you to buy goods at the quoted price. An order is accepted only when we issue written confirmation. We reserve the right to refuse any order at our discretion. Specifications described on the site are believed to be accurate but are subject to manufacturer change without notice.
For account customers, payment terms are net 30 days from invoice date unless otherwise agreed in writing. For new customers, payment is required in full before goods are dispatched. We accept payment by bank transfer (BACS), credit card and Direct Debit. Overdue amounts attract interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.
We aim to dispatch in-stock orders within one working day. Delivery times are estimates only; we are not liable for delays caused by carriers. Risk in the goods passes to you on delivery; title in the goods remains with us until payment is received in full.
All goods carry the standard Magewell manufacturer warranty (typically three years for hardware, please check the specific product). Warranty claims are processed through Magewell's standard RMA procedure; we will assist you with the process. The warranty does not cover damage from misuse, unauthorised modification, accidents, or normal wear and tear.
Faulty goods may be returned under the manufacturer's warranty as described above. Non-faulty goods may be returned within 14 days of delivery in original unopened packaging at your cost; a restocking fee may apply. Custom-configured products, opened software licences, and bespoke orders are not returnable.
Our total liability for any claim arising under or in connection with the contract shall not exceed the price paid for the goods giving rise to the claim. We are not liable for indirect, consequential or economic loss, including but not limited to loss of profit, business interruption, or loss of data. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to industrial action, acts of government, war, fire, flood, pandemic, or failure of suppliers or carriers.

These terms are governed by the laws of England and Wales. Any dispute arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
These terms, together with any written quotation we issue and the order confirmation, constitute the entire agreement between us in respect of any sale. No variation is binding unless agreed in writing.
